With rising awareness surrounding the importance of protecting one’s proprietary rights over their trademark from being misappropriated and/or illegitimately interfered with, we at Khurana and Khurana have put together an one hour interactive session to provide clarity on the process of most effectively pursuing a trademark opposition proceeding, with a step by step guide towards the overall procedure.
The Session would primarily cover the following key elements:

  • Who can file an opposition; Importance of due diligence to determine the successful enforcement of the opposition; Grounds of opposition; Provisional mandates.
  • Defensive grounds available to an Applicant when served with a notice of opposition to effectively counter the same such as Honesty in adoption; Scope of bargaining dissimilarity; no overlapping of the rival goods or services ; Prior use; Peaceful co-existence; Principle of estoppel; Relevant case laws.
  • Brief discussion on the evidence stage and its optimal use for substantiating the grounds put forth by the Opponent as well as the Applicant.

About the Speaker

 Ms. Ritwika Dasgupta Ritwika is an Associate at Hyderabad office of IIPRD and Khurana & Khurana, Advocates and IP Attorneys. She focuses on Trademark Searches, Prosecution and Drafting of Opposition matters. Ritwika has over 5 years of experience in handling Trademark Prosecutions and Oppositions. In addition to the same, Ritwika also takes care of Business Development for the Hyderabad Office. Ritwika has completed her B.A LL.B. from Calcutta University, Department of Law in 2011 and she is a member of West Bengal Bar Council.
