Prosecution of US Patent Applications in the Pharmaceutical/BioSimilar Space

Patent is one of the most effective Intellectual Property that helps achieve economic development and enables technical advancement. With an ever increasing focus of Indian Pharmaceutical Companies in the US Market, the number of Patent Applications filed by Indian entities are growing significantly year on year, be it for novel processes, new formulations/compositions, API related patent applications, and/or for novel compounds. There is therefore an imperative need for Patent Counsels, Attorneys, and Innovators to understand the latest nuances of Patent Prosecution and Preparation in the US. In sum, besides understanding Patent Laws and Practices prevalent in India, we also need to understand practices in economically and financially important geographies such as in the United States.

In order to contribute on the above agenda, Nexsen Pruet and Khurana and Khurana (K&K) are holding a Joint Webinar to demystify various aspects of patent prosecution strategies in the United States for the Pharmaceutical, Biotechnology, and Biosimilar oriented applications including practices that Applicants may adopt for comprehensive protection and enforcement. Aspects that would be covered in the webinar include:

  • Key aspects to be kept in mind while responding to US Office Actions in the Pharmaceutical/Biotechnology
  • domains with examples.
  • Case Studies indicating patentable subject matter, and how to overcome subject matter eligibility issues.
  • Aspects to be kept in mind while amending claims and adding new claim limitations in view of prosecution estoppel and future litigation/IPR proceedings.
  • Specific pointers to be kept in context while assessing Freedom to Operate (FTO) for Pharmaceutical Formulations and Compositions.

  • About the Speaker

      Mr. David S. Bradin
    David's Intellectual Property practice primarily focuses on pharmaceuticals, petroleum chemistry, polymer chemistry and biotechnology. He has assisted clients in developing world-wide patent strategies, drafted and procured patents in the U.S. and coordinated patent procurement worldwide. He has also counseled clients with respect to non infringement, invalidity and freedom to operate issues; negotiated licenses related to intellectual property; coordinated Inter Partes Review; European oppositions; assisted with patent litigation; and conducted due diligence studies and IP audits.
    As a scientist, he is named as an inventor on 10 U.S. patents and he also won an award from Innocentive for his improved synthesis of butane tetracarboxylic acid.

      Mr. Tarun Khurana
    Tarun has over 18 years of experience in a broad range of Intellectual Property (IP) subject matters, and is the Co-Founding Partner and Patent Attorney of Khurana & Khurana (K&K) and of its Patent Research and IP Asset Management Firm, IIPRD, both of which are among the Leading IP and Commercial/Corporate Law Practices with 10 Offices in India, and over 180 Professionals. The firms also have regional offices in US, Vietnam, Myanmar, Bangladesh, Malaysia, Sri Lanka, and Nepal. Tarun focuses on Patent Preparation, Prosecution and Litigation Opinions for Computer Implemented, Telecommunication, Electronics, and Mechanical subject matters. His education includes Bachelors in Computer Science from Pune University, Masters in Software Systems from BITS Pilani, Bachelors of Law from CCS University, an MBA from the prestigious IIM Lucknow, and is in pursuit of a PhD.
